1. Acceptance of Terms

By accessing or using the Agar application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Agar.

2. Eligibility

You must be at least 18 years of age to create an account and use the Service. By using Agar, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. We may require age verification and reserve the right to terminate accounts that do not meet this requirement.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate, current, and complete information during registration and keep your profile updated.
• You are responsible for all activities that occur under your account.
• You must notify us immediately at support@agar.app if you suspect unauthorized access to your account.
• You may not create more than one account per person.
• You may not transfer your account to another person.

4. Prohibited Content and Behavior

You agree not to engage in any of the following while using the Service:

• Harassment and abuse: Bullying, threatening, stalking, or intimidating other users.
• Hate speech: Content that promotes discrimination, hatred, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Fraud and deception: Creating fake profiles, misrepresenting your identity, using misleading photos, or engaging in scams.
• Impersonation: Pretending to be another person or entity.
• Illegal activity: Using the Service for any unlawful purpose, including solicitation of illegal services.
• Spam and solicitation: Sending unsolicited commercial messages or promoting products/services.
• Explicit content: Sharing pornographic, sexually explicit, or obscene material.
• Automated access: Using bots, scrapers, or automated tools to access the Service.
• Harmful content: Uploading viruses, malware, or any content designed to damage or disrupt the Service.

Violation of these rules may result in immediate account suspension or permanent termination at our sole discretion.

5. Content Ownership

You retain all rights to the content you submit to Agar, including photos, profile text, and messages. By posting content on the Service, you grant Agar a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service.

You may delete your content at any time. Upon account deletion, we will remove your content within 30 days, except where retention is required by law.

Agar's name, logo, design elements, matching algorithms, and all other intellectual property remain the exclusive property of Agar.

6. Payment Terms

• Agar offers virtual currency in the form of points or credits ("Points") that can be used to access premium features such as gifts, boosts, and enhanced visibility.
• All purchases of Points are processed securely through Stripe.
• Points are non-refundable virtual currency and hold no real-world monetary value outside of the Service.
• Points cannot be transferred between accounts, exchanged for cash, or sold to third parties.
• Unused Points will expire if your account is deleted or terminated.
• Prices for Points are displayed in your local currency at the time of purchase and may change at our discretion.
• You are responsible for any applicable taxes on purchases.

While we strive to create a safe environment, Agar does not conduct criminal background checks on users. You are solely responsible for your safety when interacting with other users, both online and in person. We recommend meeting in public places and informing someone you trust when meeting a match for the first time.

9. Termination

• You may delete your account at any time through the app settings.
• We may suspend or terminate your account at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or engaged in conduct that is harmful to other users or the Service.
• Upon termination, your right to use the Service ceases immediately. Any unused Points will be forfeited.
• Sections of these Terms that by their nature should survive termination (including but not limited to Limitation of Liability, Dispute Resolution, and Intellectual Property) will remain in effect.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Agar and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service.
• Any conduct or content of any third party on the Service, including other users.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total liability to you exceed the amount you have paid to Agar in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

12. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA).

• Arbitration will be conducted on an individual basis. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
• The arbitrator's decision shall be final and binding.
• Small claims court actions are exempt from this arbitration requirement.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
